OLD LYME WATER POLLUTION CONTROL AUTHORITY COMMISSION

UNAPPROVED REGULAR MEETING MINUTES           

Held on Thursday, June 16, 2001, 7:30 pm

Agenda Items:

  • Meeting called to order at 7:33 p.m by Chairman Dimitri Tolchinski.
The Chairman introduced a guest, Mr. Doug Whalen, President, Old Colony Beach
Association. A new Alternate Member, David Redfield was sworn in by Mervin Roberts as a new WPCA Alternate Member.

Those present and voting were the following members:

  • Approval of May 19, 2011 meeting minutes.
A motion to approve the minutes of May 19, 2011 meeting was made by
Mervin Roberts and seconded by Roger Breunig. Motion was approved by unanimous vote 5-0-0.




  • Chairman’s Report (as written)                                                                                             
June is the last month in 2010-2011 Financial Year.  Starting July 1, 2011 the new Financial Year 2011-2012 begins.  As of 06-03-2011 WPCA Budget Remaining is $6,703.48. I checked with Bryan Curtis our engineer, their coming bills will not exceed $3,072.08 Remaining Balance.  From WPCA Clerk expenses $947.50 Remaining Balance about $600 savings should be left over.  We have $200 savings from office supplies. Our savings from Legal Counsel fund should get us some money to offset $312.79 overspending in printing funds not less than $400 to $500 for other needs.  If we decide to make the mailing in June 2011, we can do it using these savings in the amount up to $1,300.
Mervin Roberts letter could be mailed together with WPCA letter to residents of Old Lyme and Lyme.
These letters should convince Lyme and Old Lyme residents to support our proposal to build COMMUNITY SEPTIC SYSTEMS for ROGERS LAKE and BEACH AREAS.  If this VERY IMPORTANT STEP will be achieved, WPCA can start moving forward and put together a plan for approval by the Town authorities, Town Meeting, State Health Department and State DEP.
This solution will bring to compliance all septic issues and will prevent expansion of sewers in our town.

Chairman Tolchinski stated that the mailing can be accomplished with the $1,300 budget savings and that money was not specifically set aside for the mailing.  Luisa Grogan asked about entries in the Chairman’s Report that differed with her figures.  
 Roger Breunig questioned addressing the letter to Old Lyme and Lyme residents.  What made him think the Lyme residents would participate?  Chairman Tolchinski stated that he had tried to contact the Lyme’s First Selectman Ralph Eno, but received no response.  Mr.Breunig asked further “Do we need to do anything with Lyme?” Chairman Tolchinski responded that there are also some houses in Lyme on the Rogers Lake shore not in compliance with their septic systems and if Old Lyme will bring to compliance their septic systems, then state will request Lyme to do the same.  Mervin Roberts explained the difference between pollution and compliance.  We don’t have visual pollution now,
he said, but in order to stave off the State Mandate of sewers, we need to be compliant with State Regulations.

  • Brian Curtis Engineering Report
Brian stated that he reviewed George James list of proposed properties for Community Septic Systems. He made the overlay drawing of these properties on Town Of Old Lyme Map for WPCA to determine if these properties are suitable to be used for community septic systems. Brian stated that that drawing doesn’t show how deep the ground water is. The Septic System needs to be 18 inches above ground water.  He stated further that WPCA keeping a close eye on lots less than 10,000 square feet.  He is working with the Assessor’s Office to utilize their database of properties that show dwellings on lots of 10,000 sq. ft. or less, so we can link it with our map to highlight the lots. Brian and Roger Breunig discussed the problem of nitrogen pollution and Brian stated that State Health Department and State DEP had different ways to look at it.  He stated that lots less than 15,000 sq. ft. would probably see a nitrogen problem. Brian stated that they would be able to test for nitrogen in ground wells we have.

  • Preparing a New Regulation
Chairman Tolchinski said that we are not ready to present this now.  We have to wait for Attorney Dubicki to provide needed corrections in existing WPCA regulation.

  • Budget
Chairman Tolchinski stated that the budget for 2011-2012 fiscal year has not been increased over last year. He spoke to First Selectman Tim Griswold about need for more funds in 2011-2012 fiscal year. Mr. Griswold recommended that if more funds would be needed, WPCA could apply for additional funds.

Roger Breunig made a motion that the distribution of the WPCA budget be accepted as presented. Aimee Eberly seconded it.
The vote was taken and approved unanimous 5-0-0.

  • Sanitarian’s Report
Ron Rose, WPCA Sanitarian, gave his report of April and May 2011 pumping out activities.  The pumping out in April 2011 was 32,350 gallons more than the previous period in 2010.  The pumping out for May 2011 in the same period was 33,750 gallons less.  The 2011 Year-to-date (May) gallons was 1,154,350.  This represents 30% increase in 2011 over 2010.

  • Any New or Old Business
Doug Whalen, President of Old Colony Beach Association asked that the three wells in Old Colony Beach be unlocked so that their engineer can test the water.  Chairman Tolchinski stated that WPCA wants to help Old Colony Beach but that only WPCA engineer – Jacobson Engineering should do it.  Roger Breunig made a motion that Jacobson Engineering should take the sample in conjunction with the Old Colony engineer and go to the lab with the sample together.  Mervin Roberts seconded the motion.  

       THE MOTION WAS APPROVED UNANIMOUS 5-0-0.


             MAILING WPCA LETTER TO THE RESIDENTS of OLD LYME.

Chairman Tolchinski passed to the present Members letter prepared by an Alternate Member Dan McFadden for the WPCA Commission for June16, 2011 Meeting. Chairman Tolchinski stated that on May 19, 2011 meeting The Commission Members were agree to make mailing of Mervin Roberts letter together with the letter from Commission Members to the Town Residents. These letters will remind people about existing situation of noncompliance of many properties in the beaches and Rogers Lake areas with the State Health Department and State DEP requirements. This mailing also will inform people in Old Lyme what WPCA Commission has been proposing to correct noncompliance of the existing septic systems in these areas by offering “The Community Septic Systems”, instead of “The Sewers” which could be “Imposed on The Town by The State DEP”.

The Chairman Tolchinski made the motion to approve the letter as written for mailing to the Town Residents. Mervin Roberts seconded this motion.
          Roger Breunig amended the motion that the Board of Selectmen will receive the letter and take a position to sign it also. Roger Breunig withdrew the amended motion after discussion.
                     THE MOTION DID NOT PASS, 2-2-1

        After discussion Luisa Grogan asked the Chairman if he would send this letter also to Tim Griswold, First Selectman?
Than Chairman Dimitri Tolchinski made a new motion to mail Mervin Roberts and corrected Commission letter to residents of Old Lyme and send this letter also to Tim Griswold, First Selectmen as a courtesy. Mervin Roberts seconded the motion.

               THE VOTE TO APPROVE THIS MOTION WAS UNANIMOUS 5-0-0


  • Adjournment
Aimee Eberly made a motion to adjourn the meeting.  Roger Breunig seconded it and the motion was approved 5-0-0.  The meeting adjourned at 9:20 pm.
